What about undocumented workers?

Many undocumented workers are not covered by workers' compensation insurance, leaving their injuries financially unprotected.
Emergency medical care is legally required, even if the patient cannot pay, shifting costs to public hospitals and state healthcare proarams.
State-funded rehabilitation and social services can cover therapy, long-term care, or support for injured workers, even if they are undocumented.
When employers operate off the books or are uninsured. workers cannot collect damages. and public programs step in to fill the gap.
Taxpayer-funded programs ultimately absorb the cost of injuries that should have been covered by private insurance.

Absolute Liability is a Myth

New York Labor Law § 240 is not strict liabilitv ~ owners and contractors are only responsible if they fail to provide proper safety equipment and protocols.
Workers who neglect their own safety are not covered.
As long as safety equipment and training was provided and available for use by the worker. the owner or contractor is not liable.
When employers operate off the books or are uninsured. workers cannot collect damages. and public programs step in to fill the gap.
Taxpayer-funded programs ultimately absorb the cost of injuries that should have been covered by private insurance.
